Family law, inheritance law and estate planning

Schaap Advocaten Notarissen has always had a strong focus on corporate law and real estate. Within the practice group for corporate law, the sub-specialization of family law, inheritance law and estate planning has continued to develop. We combine our knowledge of corporate law, law relating to property held in common ownership, inheritance law and inheritance and gift tax.

An estate planner deals with the transfer of assets to the next generation. We advise on everything related to the transfer of assets before and after death. The aim is to transfer the assets in the legally correct and fiscally most favorable manner.

Our specialists focus mainly on entrepreneurs. We serve entrepreneurs, shareholders and their family members in the area of inheritance law and law relating to property held in common ownership, cohabitation agreements, nuptial agreements, partnership agreements, wills and living wills, in order to guarantee the continuity of the business in this way as well. In some cases, the agreements are further elaborated in a family constitution. Furthermore, our team often deals with winding up the estates of entrepreneurs/shareholders and the division of the assets after divorce of entrepreneurs/shareholders, whether or not within family businesses. As estate planners, our aim is not only to deal with matters relating to property held in common ownership and inheritance law, but also with the tax consequences of the death of an entrepreneur/shareholder.
